[8] 6 - Possession of a Firearm in a Restricted Area

Includes weapons and explosives.

Any person found to be in possession of a firearm, weapon, or explosive, regardless of past criminal record or license to carry, while within the property of:

Municipal:

  • Hospitals

  • Medical Clinics

  • Police Stations and Sheriff's Offices

  • Jails and Prisons

  • Schools, Colleges, and Universities

  • Libraries

  • Court Houses

  • City Hall

  • International Airports

  • Banks

Federal:

  • Fort Zancudo

  • FBI & IAA Building

  • White House

This offence is a wobbler charge. This means that it may be either a Federal Charge or a Regular Charge depending on if violation occurred on Federal Property or regular/municipal property.

The following groups are exempt from this code.

  • G6 Security Guards (Only if the location is not government property)

  • Police Officers, Sheriff's Deputies, State Troopers

  • Officers of the Court or Justice Department, Bailiffs, Marshals

  • Agents of the Secret Service

  • Agents of the Federal Bureau of Investigation

  • Active Military Personnel or National Guardsmen on assignment or on base
